A Transfer on Death Deed allows for the transfer of ownership in certain types of real property (i.e. vacant land, a house, a condo, etc.) to a named party or parties immediately after the owner(s) of that property dies, all without going through the Probate process.
But the option to use a Transfer on Death Deed is legal and valid only for properties located in the following states:

The option to use an Enhanced Life Estate (Lady Bird) Deed is legal and valid only for properties located in the following states:
Florida, Michigan, Vermont

WHO CAN USE A TRANSFER ON DEATH / LADY BIRD DEED
An owner with a property located in one of the above listed states can create and file a Transfer on Death Deed or Lady Bird Deed.
There are almost no limits on who can be named as a Beneficiary of a TOD deed: a family member, friend, charitable organization, business, even a Living Trust. In most states, the Owner can name one Beneficiary or multiple Beneficiaries to own the property after the Owner’s death. The Owner can even name contingent (or alternate) Beneficiaries in case the initial Beneficiary predeceases the Owner.

A TOD deed can be used if there is one Owner of a property or multiple Owners. Where there is one Owner, that Owner simply names the Beneficiaries who will receive the property upon the Owner’s death, and properly identifies the property to be transferred.
Different rules apply when there are multiple Owners of a property based on how those multiple Owners hold title to the property, i.e. Tenants in Common, Joint Tenants, or Community Property.
The Owners can choose to name one person as a Beneficiary or name multiple Beneficiaries. In some states, each named Beneficiary need not receive equal ownership interest. In some states, Beneficiaries can inherit property with survivorship rights. Many states also allow for contingent or alternate Beneficiaries to be named in the TOD Deed.
As such, it is very important to review the introduction provided about your state’s laws to determine if contingent Beneficiaries can be named and to what extent such contingent Beneficiaries can be transferred the property should the initial Beneficiaries predecease the Owners.
Finally, to be effective the TOD deed must be completed, signed by the owner(s) and notarized with witnesses. Then, the TOD deed must be recorded with the office of the County Recorder or Register of Deeds while the current owners are alive.
After the death of the Owner (or the death of the last Owner for multiple owners), a TOD affidavit and a death certificate must be presented to the county recorder so that a new Deed can be recorded. The affidavit or other change of ownership document will indicate that the Owner or Owners have died and that the Beneficiaries named in the TOD deed are now the owners of the property.
While a properly signed and recorded TOD Deed can work to avoid the time, effort and cost associated with the probate process, a TOD Deed is not the proper choice for every individual in all cases. Other estate planning options may be more appropriate for a specific individual facing a specific circumstance.
